Westlake City Council plans amendments to its marijuana prohibition code

The Westlake City Council is set to have a third reading of an ordinance that supplements and amends sections of the city zoning code, aiming to maintain its prohibition on the cultivation, processing, and dispensing of marijuana within city limits. The city's planning commission recommended approval of this ordinance earlier in the week.

According to the Westlake City Council agenda for its April 4 meeting, the proposed ordinance that seeks to amend the zoning code defines key terms such as adult-use cannabis and operator, adult-use cultivator, dispensary, processor, and testing laboratory. The ordinance retains the original language that barred processing, dispensing, and testing of medical marijuana in all zoning districts.

As per the same agenda for its April 4 meeting, amendments to the ordinance clarify that despite Chapter 3780 of the Ohio Revised Code (ORC), cultivating, processing, and dispensing adult-use cannabis, cannabis, and marijuana remain prohibited within the city's corporate limits.

In line with this amendment as stated in the Westlake City Council agenda for its April 4 meeting, individuals or entities licensed as adult-use cannabis operators under Section 3780 of ORC are prohibited from opening or operating any business or commercial enterprise within the city. It further stipulates that no administrative official of the city shall approve zoning clearance or any other administrative approval. Moreover, no variance will be approved or granted for adult-use cannabis operators.
