The Bay Village City Council is set to conduct its second reading on a moratorium concerning adult use or recreational marijuana-related activities for the remainder of 2024.
According to the council's March 18 meeting agenda, the resolution for the moratorium indicates that the city requires time to review state codes, regulations, and local ordinances. This is in order to formulate an appropriate local response following Ohio voters' approval of Issue 2, which enacted a state code legalizing adult-use marijuana. The legislation under Chapter 3870 grants a municipal corporation the legal authority to either allow, limit, or prohibit adult-use cannabis operators.
Chapter 3870 also mandates that the state must establish a set of rules and regulations governing the cultivation, processing, sale, purchase, possession, home growth, and use of cannabis by adults aged at least 21 years. The council's resolution points out that these rules and regulations have yet to be established.
As per the Bay Village City Council's March 18 meeting agenda, it is proposed that the city's moratorium would commence upon approval and run through Dec. 31. This would preclude any consideration, approval, issuance or authorization of permits enabling the cultivation, processing or retail sale of adult-use cannabis during this period. These restrictions extend to a halt on building permits or certificates of occupancy for any building or structure intended for such activity within city limits. It also covers submitting, considering or approving applications for general development plans, final development plans as well as special or accessory use permits.
The council retains the right to extend this moratorium if deemed necessary according to its March 18 meeting agenda.
